1. Agreement to terms

By accessing or using the Salty Dog Crew platform, mobile applications, or delivery services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.

These Terms constitute a legally binding agreement between you and Salty Dog Crew LLC ("we," "us," or "our").

2. Description of services

Salty Dog Crew is a platform that connects customers with locally operated franchise delivery services for water, water softener salt, and related products. Individual franchises operate independently and are responsible for fulfilling deliveries in their service areas.

3. Accounts

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the security of your account credentials and for all activity under your account.
  • You agree to provide accurate and complete information when creating your account and to keep this information up to date.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Orders and subscriptions

  • Recurring orders: subscriptions automatically generate delivery orders on your chosen schedule. You can pause, adjust, or cancel at any time through the app.
  • Cancellation: you may cancel your subscription at any time. Cancellations take effect at the end of the current billing period unless otherwise stated.
  • Scheduling: delivery days are estimates. Actual delivery times may vary due to route optimization, weather, or other factors. We will notify you of changes.
  • Missed deliveries: if a delivery cannot be completed (e.g., inaccessible address, locked gate), we will attempt to reschedule at no additional charge.

5. Pricing and payment

  • Prices are set by local franchise operators and may vary by service area.
  • Payment is due upon delivery or as otherwise agreed. We charge the payment method on file after each successful delivery.
  • Failed payments will be retried. If payment cannot be collected after multiple attempts, your service may be paused until payment is resolved.
  • Prices may change with 14 days' advance notice. Continued use of the service after a price change constitutes acceptance.
  • All payments are processed by Stripe, Inc. and are subject to Stripe's terms of service.

6. Delivery and access

  • You are responsible for ensuring safe, accessible delivery conditions (clear pathways, unlocked gates, leash or secure pets).
  • Our delivery staff will photograph completed deliveries as proof of service.
  • We are not liable for damage resulting from pre-existing conditions at the delivery location or for items left unattended after delivery.

7. Refunds and credits

If you are unsatisfied with a delivery, contact us within 48 hours of the delivery date. We will review the issue and, at our discretion, issue a credit, replacement delivery, or refund. We do not issue refunds for deliveries that were completed as scheduled where access issues prevented delivery.

8. Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose.
  • Attempt to gain unauthorized access to any part of the platform.
  • Interfere with or disrupt the Services or servers connected to the Services.
  • Reproduce, duplicate, or resell any part of the Services without our written permission.
  • Harass, threaten, or abuse Salty Dog Crew staff or delivery personnel.

9. Intellectual property

The Salty Dog Crew name, logo, app, website, and all related content are owned by Salty Dog Crew LLC and protected by copyright, trademark, and other intellectual property laws. You may not use our branding without prior written consent.

10. Disclaimer of warranties

The services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, Salty Dog Crew LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the services. Our total liability for any claim shall not exceed the amount you paid us in the 90 days preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Salty Dog Crew LLC, its officers, directors, employees, and franchisees from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Utah County, Utah.

14. Changes to terms

We may update these Terms from time to time. We'll notify you of material changes via email or in-app notice. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
